The Litigation Department at Rosenn Jenkins & Greenwald, LLP, consists of outstanding attorneys, knowledgable in various aspects of litigation. With many years of combined experience, our Litigation Department can give each client the most skillful and determined respresentation that they deserve to meet their legal needs.
The Plantiffs' Personal Injury Practice Group
The Plantiffs' Personal Injury Practice Group, is one of several groups formed within the Litigation Department. The Plantiffs' Personal Injury Practice Group has the training, experience, knowledge and staff to handle all types of personal injury claims. This group has represented major products liability claims, slip and fall claims, worker's compensation claims, in addition to a variety of motor vehicle and other negligence actions.
When an international singing star was injured in a motor vehicle accident in the Pocono's, Rosenn Jenkins & Greenwald, LLP's Litigation Department was retained as her counsel in Northeastern PA, for her matter in seeking compensation for her injuries.
If trial is the necessary course of action, the department will provide rigorous representation. If the case should be settled, rather than tried, the department will advise our client accordingly. Our clients benefit from our knowledge and experience in negotiating structured settlements, where appropriate, which may provide a stream of tax-free income for years.

The Commercial Litigation Practice Group
The Commercial Litigation Practice Group consists of attorneys in the Litigation Department most experienced in commercial litigation matters. The group's vast knowledge and depth of experience has been applied to a variety of disputes, including securities, construction contracts, merger and acquisition agreements, financial transactions, secured transactions and commercial real estate transactions.
Since litigation of this nature is often complex and protracted and requires segmenting of responsibilities, the group has developed a team approach with a partner in charge and at least one associate and one paralegal for each case.
The Construction Law Practice Group
The Construction Law Practice Group has considerable experience in handling complex construction disputes. In addition to jury and bench trials, we are experienced in arbitrating cases before the American Arbitration Association. We have a detailed working knowledge of the various AIA documents generally used as the basis for the relationship between the owner and the general contractor and subcontractor, and the owner and architect. We have followed the evolution of the law and counsel clients on negotiating and drafting these documents.
The issues that we have encountered on a regular basis include jurisdictional disputes, authority of arbitrators, appeal of common law and/or statutory arbitration award, delay damages, liquidated damages, direct labor overrun, extended overhead costs, lost profits, costs of capital, idle or unproductive equipment, pre-judgment interest, attorneys' fees, punitive damages, standard of care applicable to architects and engineers, cost to repair versus diminution in a value, implied warranty, third party beneficiary, differing site conditions and claims under labor and material payment bonds and performance bonds. We work closely with our clients and, where appropriate, with experts in the fields of engineering and accounting, in order to assure that the case is properly developed and documented.
The Employment/Civil Rights Litigation Practice Group
The Employment/Civil Rights Litigation Practice Group represents both public and private sector clients in litigation in the State and Federal Courts in Pennsylvania . The Employment/Civil Rights Litigation Practice Group has the ability to practice in the State and Federal Courts in New Jersey and New York .
The Employment/Civil Rights Litigation Group defends employers against discrimination and/or harassment complaints that may be brought in court after the conclusion of the administrative process. Our group also represents clients in breach of contract, misappropriation and other employment-related claims. In both employment and civil rights litigation, we frequently represent clients in alternative dispute resolution forums such as mediation and arbitration.
The Workers' Compensation Practice Group
The Worker's Compensation Practice Group consists of experienced attorneys and paralegals who work closely together to obtain the best possible result for our clients. We represent clients in regard to claims and other issues arising under Pennsylvania Workers' Compensation Act, which governs the payment of workers' compensation benefits, such as wage loss and medical benefits, to injured employees.
In addition our clients include employers engaged in manufacturing, construction, health care and service industries and we have been retained both by insurance carriers and self-insured employers. We also regularly counsel our clients on various matters involving workers' compensation law, such as coverage requirements, modified employment and settlement.
We represent clients before Workers' Compensation Judges, the Pennsylvania Workers' Compensation Appeal Board, and the Commonwealth Court.
The Criminal Law Practice Group
The Criminal Law Practice Group represents corporations, corporate officers, directors and employees facing criminal investigations by state and local authorities and such investigative agencies as the Federal Bureau of Investigation and the Internal Revenue Service Criminal Investigation Division. We advise clients on responding to subpoenas, conduct internal investigations, negotiate with prosecutors, and handle motions and trials.
The Insurance Defense Practice Group
The Insurance Defense Practice Group provides experienced, skilled defense to corporations and municipalities on behalf of insurance carriers as well as self-insureds. We provide a wide variety of representation in both personal injury and property damage claims, including automobile liability, liquor liability, premises liability, construction liability, professional malpractice including, medical, legal and accounting and real estate malpractice, products liability, and first party insurance claims. We represent our clients at all levels of practice before state and federal courts, from magistrate's court and arbitration-level cases to complex jury trials.
Our attorneys also appear regularly in the appellate courts of both the state and federal systems. In addition, we defend clients in private arbitration and Alternate Dispute Resolution proceedings.
